Was waren das noch für Zeiten! Damals, vor dem 1. Januar 2013, als Sätze wie "Ich bin auf Medien-Diät" oder ein schlichtes "Ich muss hier gar nichts, und jetzt raus aus meinem Flur" dazu geführt haben, den GEZ-Beauftragten vor der Haustür abzuwimmeln. Dann wurde die "Gebühreneinzugszentrale" in "Beitragsservice" umbenannt und eine neue gesetzliche Grundlage für die Gebühren eingeführt.

Seitdem muss nicht mehr nach Art des Rundfunkgerätes bezahlt werden, sondern pro Haushalt. Der Pauschalbetrag beträgt 17,50 Euro im Monat, muss dafür aber auch bei mehreren Bewohnern nur einmal pro Wohnung bezahlt werden. Dieses Geld finanziert die öffentlich-rechtlichen Sendeanstalten ARD, ZDF und Deutschlandradio. Rechtlich ist dieses Modell durch den "Rundfunkbeitragsstaatsvertrag" festgeschrieben.

Alle müssen den Beitrag zahlen

Um es mal vorwegzunehmen: Dein total cleverer Plan, einfach nicht zu zahlen, ist zum Scheitern verurteilt. Denn deine kleinkriminellen Glücksgefühle finden spätestens mit dem GEZ-Brief, der dich zum Gebühren bezahlen auffordern wird, ein jähes Ende. Dieses Schreiben haben die meisten Haushalte direkt zur Umstellung der Gebührenpflicht erhalten. Doch aufgrund des großen Aufwands zum Datenabgleich zwischen den Ämtern und den Sendern kommen viele Anschreiben mit Verzögerung – gerade bei denjenigen Personen, die vor 2013 noch keine Gebühren bezahlt haben.

"Den Bescheid bekommt man mit sehr großer Sicherheit. Die GEZ bekommen die Daten von den Meldeämtern – das dauert einfach eine gewisse Zeit, bis alle Daten angeliefert und abgearbeitet worden sind. Aber irgendwann ist man dann mal an der Reihe", erklärt der Rechtsanwalt und GEZ-Experte Jakob Heinrich Tschuschke. Die ersten Zahlungsaufforderungen sind noch unverbindlich, aber der Beitragsbescheid wird schon nach einem Monat bestandskräftig – wer nicht zahlt, kann im schlimmsten Fall mit einer Lohnpfändung rechnen.

Gibt es noch die Möglichkeit zur Befreiung?

Wer BAföG bezieht, kann sich von der Beitragspflicht befreien lassen. Für eine WG kann das schwierig werden, denn erst wenn alle Bewohner Sozialleistungen nachweisen können, kann der Haushalt von der GEZ befreit werden. So muss sich die Wohngemeinschaft darauf einigen, ob der Beitrag brüderlich geteilt wird oder ob nur diejenigen zahlen müssen, die nicht befreit sind.

Für Studierende, die an der untersten Einkommensgrenze sind, gibt es laut Tschuschke ebenfalls Möglichkeiten zur Befreiung: "Diejenigen müssen zum Sozialamt gehen. Nicht um Leistungen zu beantragen, sondern um die Einkommensverhältnisse offenzulegen und eine Bescheinigung zu beantragen, dass der Verdienst unterhalb der Einkommensgrenze liegt." Der Befreiungsantrag sollte so schnell wie möglich ab dem Zeitpunkt der Bewilligung der sozialen Leistungen (auch BAföG!) gestelltwerden, weil die GEZ eine Zwei-Monats-Frist zur rückwirkenden Freistellung eingerichtet hat. Wer den Antrag später einreicht, kann nur noch ab dem nächsten Monat befreit werden und muss für die letzten Monate zahlen.

Droht eine Nachzahlung?

Prinzipiell ja. Da durch den Staatsvertrag gesetzlich festgelegt ist, dass jeder Haushalt seit dem 1. Januar 2013 bezahlen muss, sind auch diejenigen, die bisher nichts gezahlt haben, zahlungspflichtig – auch rückwirkend. Wer in einer WG wohnt und nachweisen kann, dass dort schon für die Wohnung bezahlt wird, ist davon natürlich nicht betroffen. Für alle anderen gilt leider: Es ist unumgänglich, dass eine Nachzahlungsaufforderung auf euch zukommen wird.

Doch auch dafür hat Tschuschke noch einen Tipp: "Wer eine Vorbehaltserklärung zu seiner Zahlung abgibt, kann mit einer Rückerstattung rechnen, falls laufende Gerichtsverfahren die Rundfunkgebühren doch noch als verfassungswidrig einstufen." Denn viele Klagen laufen momentan noch, Entscheidungen dafür sind erst in ein paar Jahren zu erwarten.

LOLI'm now onto Damien, however, I must wait for the audiobook to come out later this month, because I don't think I can read the books no.
